Contentious Probate

 

With an ageing population, changes to family structures and increased passing of generational wealth, families are finding it more and more difficult to balance the needs and expectations of their families when it comes to distributing their assets. The result is an increase in inheritance and will disputes.


A Will can be challenged for a number of reasons. For example, a family member or other interested party might feel that they have not been fairly treated in the Will. 


Alternatively, the claimant may suspect that the Will was made under duress or without proper legal formalities – both reasons that could result in a Court ruling to decide whether the Will is invalid.
